Terms and Conditions

1. Acceptance
By creating an account on Helm, signing in, or using any feature of the platform, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use Helm.
2. About Helm
Helm is the internal volunteer-management application of Making Waves Foundation. It supports rostering, membership, accreditation, attendance, incident reporting, and program operations for our sailing programs across Australia. Helm is offered free of charge to volunteers and program participants. Annual volunteer membership fees, where applicable, are processed through our payment provider.
3. Eligibility and accounts
- You must provide accurate, current information when registering.
- One account per person — please don't share credentials.
- You are responsible for keeping your sign-in credentials secure and for any activity carried out from your account.
- If you suspect your account has been compromised, contact info@makingwaves.au immediately.
- For under-18 users (Wright of Passage participants and family-supporter accounts), a parent or guardian must register and consent on the young person's behalf.
4. Volunteer responsibilities
If you sign up to crew with us:
- Maintain a current Working with Children check for the state in which you sail and update Helm when it renews.
- Follow the Volunteer Standard Operating Procedures provided to you on induction. Take particular care with safety briefings, pre-departure and pack-down checklists, and on-water conduct.
- Cancel a roster commitment as early as possible if you can no longer attend, so the coordinator can find a replacement.
- Honour participants' photo-consent settings — do not photograph or record participants whose record indicates they have not consented.
- Treat fellow volunteers, participants, families, and staff with respect.
5. Acceptable use
You agree not to:
- Use Helm for anything other than Making Waves Foundation's charitable purposes.
- Harass, abuse, or impersonate any other user.
- Upload content you don't have the rights to share, including photos of people who have not consented.
- Interfere with the platform's operation, attempt to access data you are not authorised to see, or probe for vulnerabilities outside an agreed responsible-disclosure process.
- Scrape, copy, or repurpose Helm content for unrelated purposes.
6. Content you upload
Photos, videos, comments, incident reports, and other content you upload remain yours. By uploading, you grant Making Waves Foundation a non-exclusive, royalty-free licence to use that content for our charitable purposes — running programs, training other volunteers, telling our story to supporters and funders, and meeting governance and reporting obligations. We will respect any photo-consent restrictions on participants visible in the content.
You confirm, by uploading, that you have the right to do so and that no one in the content has objected to its use by Making Waves Foundation.
7. Payments
Annual volunteer memberships and donations are processed by Stripe, an independent payment provider. By making a payment you also agree to Stripe's terms. Making Waves Foundation does not receive or store your card details. Refund requests are handled at the discretion of Making Waves Foundation — contact info@makingwaves.au.
8. Suspension and termination
We may suspend or close an account at any time, without prior notice, if a user breaches these Terms, the volunteer SOP, or where their continued access poses a risk to participants, fellow volunteers, or the foundation. You may close your own account at any time by emailing info@makingwaves.au; we will retain records as set out in the Privacy Policy.
9. Disclaimer and liability
Helm is provided "as is" and "as available". We make no warranties, express or implied, about its fitness for any particular purpose, accuracy, or uninterrupted availability. To the extent permitted by law, Making Waves Foundation is not liable for indirect, incidental, or consequential loss arising out of your use of Helm. Nothing in these Terms limits any consumer rights you may have under the Australian Consumer Law.
10. Governing law
These Terms are governed by the laws of New South Wales, Australia. You and Making Waves Foundation agree to submit to the exclusive jurisdiction of the courts of New South Wales for any dispute arising out of these Terms.
11. Changes
We may update these Terms from time to time. The current version is 2026-05-04. When changes are material, we will prompt you to re-acknowledge them on next sign-in. Continued use of Helm after a change constitutes acceptance of the updated Terms.
